Description

The presenters address the cost aspect of litigation, both from a purely financial perspective as well as the "cost" of allowing the opposing side to learn your litigation strategy and techniques. They explore when a case is going to trial and the government elects to utilize its in-house appraiser rather than an outside appraiser, what is the "cost" of allowing taxpayer's counsel to depose that appraiser? Is the potential risk of allowing opposing counsel to learn litigation and/or settlement strategies employed by the governmental entity worth the funds saved by not hiring an outside expert? On the other side, how much in tax savings needs to be at issue before going to the courthouse is worth all of the financial cost involved?
